Morris Buckhantz died testate on March 18, 1950, and his will was admitted to probate. All property in which Buckhantz had an interest was community property of himself and his wife, Jeannette. The will disposed of all the community property and required Jeannette to elect whether she would accept the provisions of the will or "the rights which might be given her by law." It bequeathed and devised the property to Jeannette, a sister, various relatives, employees and charitable institutions. The residue was given to a trust company in trust with directions to apportion it into three equal parts without physical segregation; Jeannette was given the income from two parts for life with power of appointment of those parts, and the sister was given the income from one part with the remainder of that part to her sons. The will made no provision or direction as to the federal estate tax.
